What is an arbitration agreement? This is typically a clause in a broader contract in which you agree to resolve a dispute outside of court through a neutral third-party arbitrator. Arbitration agreements are common in consumer-facing agreements and employment contracts. To reduce costs and improve the efficiency of dispute resolution, it is common for businesses to require their customers to sign an arbitration agreement.
In all payment solutions serviced by American First Finance, the payment solution agreement will include an arbitration provision. In a typical arbitration, a trained, professional, and neutral arbitrator acts similarly to a judge who will make a decision to end any dispute. However, arbitration is most often seen as an attractive process because the process is usually completed more quickly and is less formal than litigation.
Unless prohibited by applicable law or unless you reject the Arbitration Provision in accordance with the opt-out clause in American First Finance’s Arbitration Provision in the American First Finance payment solution agreements, the document says that you and American First Finance agree that either party may elect to require arbitration of any claim under the terms and conditions documented in the Arbitration Provision. A similar provision is included in agreements for payment solutions originated by other parties but serviced by American First Finance.
